11-Year-Old Sexually Abused And Raped By A Neighbour In Bathinda, Police Refuses To File An FIR

On February 8, 2021, an 11-year-old cheerful boy went to play in the field near his house in Bathinda. But little did he know what trauma lay in front of him. He returned home sobbing and trembling with fear, indicating something was amiss. In a muted tone, the young boy told his mother that their neighbour, Jaswinder Singh, took him to the motor room, forcefully removed his clothes, fondled his private parts, made him perform oral sex, and raped him.

Recalling the horror, the victim's mother said,

20-25 minutes after he came home, he told me what had happened to him. He was sobbing uncontrollably. I immediately informed his father, and we took him to the police station to file a complaint.

Determined to bring the guilty to book, the child's parents went to the police station to register a complaint. Little did the parents know that the road to justice will not be smooth. The Assistant Sub-Inspector refused to lodge a complaint. Instead of helping the family by registering an FIR, the ASI misled them saying that they will jeopardise their son's future by doing so. Meanwhile, the accused was threatening the family with dire consequences if they went ahead with the FIR.

The Sub-Inspector told us that we will jeopardise our son's future. He told us your son will face problems going to school, how will you get him married? He told us not to inform the panchayat and to suppress the matter, said the victim's father.

Scared for their lives, the child's family returned without registering the FIR. A few days later, when the case came to the notice of the village panchayat, they forced a compromise between the two parties and asked the accused to leave the village for six months. Unable to bear the mental trauma the child slipped into depression. Having lost all hope, his family finally saw a ray of hope when Kailash Satyarthi Children's Foundation's sister organisation Bachpan Bachao Andolan (BBA) intervened on receiving the information about the case through its network of volunteers.

Sharing the steps taken by the team of Bachpan Bachao Andolan, Yadvinder Singh, State Coordinator, BBA said,

Two and a half months later an FIR was lodged and 15 days later we got a medical exam done. We got in touch with District Legal Services Authority to provide us with an advocate. We also wrote to them for victim compensation. 

BBA sent a formal complaint to the SSP and SHO of Bathinda district on the same day and coordinated with ChildLine. BBA also explained the provisions of the Protection of Children from Sexual Offences (POCSO) Act to the SHO of the police station. Especially sections 19 and 20 which include mandatory reporting of the crime. This led to the registration of the FIR. The child's statement under Section 164 was also recorded and a medical examination was also conducted.

BBA also coordinated with the school and District Child Protection Officer to ensure the child's education didn't get hampered. The case was followed up with the Woman and Child Development department to provide a support person for the victim. BBA has also written to District Legal Services Authority to provide legal aid and ensure interim compensation for the child.
