Luthra Brothers Deportation Updates: Luthra brothers - Saurabh and Gaurav - the principal owners of 'Birch by Romeo Lane', a nightclub in Goa that caught fire on December 6, killing 25 people, are back in India after deportation from Thailand. The two are likely to be produced before the Patiala House Court, with officials seeking their transit remand.

The Luthra brothers booked tickets to Phuket, Thailand on the intervening night of December 6 and 7, at a time when the Goa Police and Fire Services teams were engaged in rescue operations at the nightclub. The two were spotted during an outing in Phuket and detained from their hotel room in Thailand following a request from India on December 11.

Luthra Brothers Case LIVE Updates | Recap: Goa Club Owners Fled To Thailand After Deadly Fire
The Bureau of Immigration at Mumbai airport found out that the two accused - Saurabh and Gaurav Luthra - flew out to Thailand's Phuket at 5.30 am on December 7, which placed the time just hours after the deadly fire incident happened. The two brothers were in Delhi when the fire broke out at their night club, Birch by Romeo Lane, in north Goa. 

They took an IndiGo flight 6E-1073 to escape to Thailand. IndiGo's flights to destinations outside India were not affected by the pilot rostering issues, which in India led to massive disruption in domestic operations.

Luthra Brothers Goa Club Fire Case LIVE: NDTV Accesses Blue Corner Notice Against Luthra Brothers
The Blue Notices issued against the two brothers accuse them of injury causing death, manslaughter and murder. The notice accuses Saurabh Luthra, Gaurav Luthra and other partners of organising a fire show "without taking proper care and caution and without providing fire safety equipment, other safety gadgets."

On December 6, at 11:45 pm, the fire show led to a "serious fire" leading to death of 25 people, including five tourists.

The Luthra brothers organised the fire show despite knowing that their nightclub did not have an emergency exit door on the ground floor or on the deck floor to evacuate in case of emergency, the notice read.

The blue notice also accuses Luthra brothers of operating a "restaurant without obtaining essential permission or licenses from competent authorities."

The investigation into the fire has revealed how the violation of safety norms turned the nightclub into a tinderbox. The club had no functional fire extinguishers or safety alarms, and the access road was too narrow for fire engines. There was no emergency exit either. The restaurant was found operating without proper permissions and licences, according to the FIR registered after the fire. Despite several warnings, the club management did not rectify the safety lapses, the probe has found. The investigators have also said that a former IPS officer's intervention played a role in disposing of a case against 'Birch By Romeo Lane' in the past. This intervention, investigators say, emboldened the owners to continue flouting norms. And then, a tragedy that was waiting to happen claimed 25 lives.

Goa Nightclub Fire: What Happened At 'Birch By Romeo Lane'
The first emergency call - to firefighters - went out at 12.04 am on December 7.

Minutes before that, as the clock ticked down to midnight, the dance floor at one of Goa's most popular nightclubs was packed. Tourists and locals swayed to the beats of Sholay chartbuster 'Mehbooba...', led by Kristina Sheikh, a professional dancer from Kazakhstan.

A video from the floor - one of a few investigators will use to try and re-construct the moments that led up to the fire - showed Kristina performing on stage, backed by a group of musicians.

Electric firecrackers go off in the background and the cheers grow louder.

According to survivors, moments later flames licked the ceiling and two staff members rushed to remove a laptop from its path. But there was still no alarm or announcement; in fact, in the video someone can be heard complimenting the dancer for having 'set the stage on fire'.

From Goa Nightclub Fire To Thailand Deportation: Luthra Brothers' Journey
The Luthra brothers have been deported from Thailand to face criminal charges after 25 people were killed in a fire at their Goa nightclub, 'Birch by Romeo Lane', midnight on December 7.

NDTV has accessed visuals of Saurabh Luhtra and Gaurav Luthra of boarding IndiGo flight 6E1064 that is to land in Delhi at 2 pm. The brothers fled India - though they later told a Delhi court they travelled for business purposes - hours after the fire broke; according to the police they booked tickets on MakeMyTrip.com at 1.17 am, even as firefighters were struggling to put out the blaze.

Tracked down and detained by Thai police, the Indian government suspended their passports - to stop them escaping further - and worked with immigration authorities to bring them back.

42 Companies, 1 Delhi Address: Inside Luthra Brothers' Business Network
Corporate filings show that the Luthra brothers are directors or partners in 42 different entities, including private limited firms and limited liability partnerships (LLPs).

In an unusual pattern flagged by investigators, most of these companies are registered to a single address: 2590, Ground Floor, Hudson Line, North West Delhi.

This repetition of a common address across dozens of companies is a known red-flag indicator in financial investigations, often associated with shell entities, anonymous fund routing and potential money laundering.

Several marketing campaigns of the Romeo Lane group have claimed an international presence in Phuket, Thailand.

However, checks by investigators found no operational outlets, customer reviews or any verified business addresses.

How Centre Used Passport Law To Corner Luthra Brothers In Thailand
The Centre used Section 10A of the Passport Act to suspend Luthra brothers' passports. Section 10A empowers authorities to stop individuals from travelling. At the same time, the Central Bureau of Investigation (CBI) issued a Blue Corner notice against the brothers, further cornering them. 

According to government sources, once their passports were suspended, the Luthras' stay in Thailand became illegal and Indian authorities managed to get their Thai counterparts detained.

Luthra Brothers Deported: How Is It Different From Extradition?
India and Thailand signed an extradition treaty in 2013, under the terms of which Bangkok is obliged to send the Luthra brothers back if the charges they face carry a minimum jail term of a year.

The main (at this time) charge Saurabh and Gaurav Luthra face is culpable homicide not amounting to murder, which carries a minimum sentence of five years.

That satisfies the main operational criteria of the 2013 treaty.

Therefore, one option is to activate relevant provisions of the treaty.

But typically this involves a formal request and proving 'double criminality', i.e., present evidence to a Thai court that says the accused is guilty of a crime punishable by both Indian and Thai laws.

Also, attempts to extradite other wanted individuals - Nirav Modi and Vijay Mallya from the United Kingdom, Mehul Choksi from Belgium, and Dawood Ibrahim from Pakistan - have rumbled on for years.

Detained To Deported: Luthra Brothers To Land In Delhi Shortly
Luthra brothers were detained by the Thai authorities in Phuket following a request from India.

The Luthras were then brought to Bangkok by Thai officials and kept at the Suan Phlu Immigration Detection Centre.

The two brothers have been deported to India. The two brothers boarded an IndiGo flight (6E1064) this morning and are expected to reach Delhi around 2 pm (IST).
